Terms of Service
The rules for using Chase House and collecting with us.
1. About these terms
Hypetheory LLC, a Texas limited liability company, operates Chase House (“we,” “us,” and “our”). These terms cover our website, accounts, packs backed by physical collectibles, collection and custody services, buybacks, funding, eligible payouts, and shipping, where available. Our Privacy Policy explains information handling; our Returns & Refunds Policy covers cancellations, returns, and refund requests.
By creating an account, confirming that you accept these terms, or using the service, you agree to these terms. If you do not agree, do not use the service. The offer and transaction details shown before you confirm a purchase or other transaction form part of that transaction’s terms. If you do not agree to the applicable terms, do not complete that transaction. Additional features or promotions may have separate terms presented before participation.
2. Eligibility and accounts
You must be at least 18 years old or the age of majority where you live, whichever is higher. You must also meet the location, identity-verification, and other eligibility requirements disclosed for the feature you use. Do not use the service where prohibited by law, misrepresent your identity or location, or bypass restrictions. Browsing, signing in, or holding a card does not by itself make you eligible for every feature.
Paid features are available only in the locations expressly supported for that feature and where permitted by applicable law and payment-provider requirements. Funding, purchases, payouts, and shipping may have different restrictions. The applicable availability must be shown before you authorize the affected transaction. You must be physically in an eligible location when a feature requires it; do not use a VPN or other method to evade a restriction.
Provide accurate information and keep your account credentials secure. Use only payment methods and payout destinations you are authorized to use. Notify us promptly if you suspect unauthorized access or a transaction you did not authorize. We may request information reasonably needed to investigate or verify access.
3. Packs and purchase confirmation
An ordinary Chase House pack is an offer over eligible physical card inventory, not necessarily a factory-sealed booster. Before confirming, review the price, currency, applicable fees, pool information, and outcome disclosures shown for that offer.
The service records the selected physical card and your purchase. The reveal animation displays that recorded result; replaying it does not create another purchase or a different result. Contact support if a charge or result appears incorrect rather than repeatedly submitting a new purchase.
Pack purchases are final once opened. Not liking the selected card or its value does not qualify for a cancellation or reroll. Payment errors, failure to receive the recorded card, and rights provided by applicable law remain subject to review under our Returns & Refunds Policy.
Ordinary packs are configured for 100% expected card value: the probability-weighted average of the displayed card valuations equals the pack price when purchased. This is an average across possible outcomes, not a guarantee for an individual pack or a promise of cash back. A particular card may be worth more or less than the pack price. Sell-back proceeds reflect the separate buyback percentage.
Possible outcomes differ in value. No particular card, resale value, profit, or future sell-back offer is guaranteed. Published valuations are estimates as of their stated time and may change. Concept artwork and previews do not identify live stock unless the offer expressly says so.
4. Funding, balances, and payments
Deposited funds are for purchasing packs; they are not directly withdrawable as cash. Eligible proceeds from a completed buyback may be withdrawn through the methods available to your account, subject to verification, holds, limits, and fees disclosed before confirmation. A refund of an unused or erroneous deposit is a separate request reviewed under our Returns & Refunds Policy and applicable law.
Review the total amount and applicable fees before authorizing a payment. A browser confirmation does not necessarily mean funds are available. Payments may remain pending until confirmed through the payment process.
Your account distinguishes deposited funds, eligible sale proceeds, promotional value, and held amounts. These categories can have different spending, refund, and withdrawal rules. Promotional value is not automatically withdrawable, and the ability to spend a balance does not mean that amount is eligible for payout. Applicable restrictions must be disclosed before you fund or use the affected value.
We may place a transaction or amount on hold for verification, an unresolved payment, a dispute, or another legitimate risk or legal reason. We will not treat an ambiguous payment response as proof that a second payment is needed. Contact us about duplicate charges, failed credits, or other payment errors.
Our providers, including Coinflow where enabled, may require their own terms and verification. Provider availability, limits, fees, and settlement times may affect a transaction. Do not assume funds are protected or insured beyond any protection expressly identified for the applicable service.
5. Card ownership and custody
Your collection identifies the specific physical cards recorded as yours. Keeping a card with Chase House leaves it in our custody until an authorized transfer, completed sell-back, or physical shipment. Custody does not itself authorize us to allocate your card to another customer.
Card descriptions identify the applicable variant, condition, grading details, and other relevant facts. Review them carefully and report a mismatch. A grading opinion or market estimate does not guarantee a future grade or sale price. We may temporarily restrict a card while resolving a documented custody, ownership, or delivery issue.
6. Sell-backs and seven-day automatic sales
An eligible sell-back transfers your card to Chase House and credits the net proceeds to your account. It is a separate sale, not a refund of your pack purchase. Our standard buyback pays 90% of the applicable card valuation with no additional sell-back fee. We show the valuation and the amount you will receive before you accept a manual offer. Accepted sales are final, subject to correction of errors and applicable law.
When an automatic-sale deadline is disclosed before purchase and shown in your collection, you authorize us to sell the card back automatically after seven days (168 hours) from its recorded acquisition. Viewing or replaying a reveal does not reset the deadline. To keep the physical card, submit an eligible shipping request before that deadline.
Automatic sales pay 90% of the card’s valid, reviewed valuation at the time of processing, with no additional sell-back fee. We record the valuation, buyback amount, ownership transfer, and proceeds. A card awaiting shipment or already shipped is excluded; a card under review or without a valid valuation waits until the issue is resolved.
If you cancel shipping, the original deadline applies again; any elapsed deadline and resulting automatic-sale eligibility must be disclosed before cancellation. This policy does not create an undisclosed or retroactive deadline for cards acquired without it. A card cannot be shipped and sold back in the same transaction.
7. Payouts
Only available proceeds that meet the disclosed eligibility rules may be paid out. Identity checks, destination ownership, location restrictions, minimums, fees, and holds may apply. Deposited or promotional value must not be assumed to have the same payout treatment as eligible sale proceeds.
Requested payout funds are reserved while the request is processed and cannot be spent again. A provider’s submission notice is not necessarily final receipt by your bank. Failed, returned, or delayed payouts are reviewed against the provider’s status before funds are released or another payout is submitted.
8. Physical delivery
Physical delivery is available to the 50 United States and Washington, DC. International destinations, US territories, and military addresses are not supported at launch. US shipping is a flat $5 USD per card. Each card is shipped individually in its own package; cards are not combined into one shipment. For example, shipping three cards costs $15 USD. Shipping is available for eligible cards you own. Review the destination, delivery estimate, and any applicable taxes shown before confirming. A label being created does not mean the carrier has received the package.
Contact us promptly about delays, an incorrect delivery, damage, or a missing package. We will review the issue and available remedies under our Returns & Refunds Policy and applicable law. Any mandatory shipment-delay, cancellation, or refund rights remain available.
9. Fair use and restrictions
Do not use stolen payment information, manipulate accounts or outcomes, exploit an error, abuse promotions, submit false claims, interfere with the service, or evade safeguards. We may restrict a feature or suspend an account to investigate a documented issue, prevent abuse, or comply with law.
A restriction does not automatically cancel your ownership or eliminate a valid claim to funds. Contact us about access to records or arrangements for eligible balances and owned cards. Any adjustment must have a legitimate basis and remain subject to applicable law.
10. Intellectual property and availability
Website content and branding belong to us or the relevant rights holders. You may use the service for its intended purpose, but access does not transfer rights in the website, software, or third-party trademarks. Ownership of a physical card does not transfer intellectual-property rights in its artwork or brand.
We aim to keep information accurate and the service available, but errors and interruptions may occur. We may maintain or change features prospectively. A later offer or price change does not silently change a completed transaction.
11. Errors, disputes, and your rights
Contact us with the account, transaction, or shipment reference and a description of the problem. We may request information reasonably needed to investigate. You do not give up a mandatory right or payment-dispute remedy by using our support process.
Collectibles are not offered as guaranteed investments. To the extent permitted by applicable law, we do not guarantee uninterrupted availability, future market prices, or a particular financial outcome. Nothing in these terms excludes liability or a remedy that cannot lawfully be excluded.
12. Account closure
You may stop using Chase House or request account closure at ely@hypetheory.net. Signing out does not delete transaction records or transfer ownership of your cards. We will work with you to resolve outstanding shipments, eligible funds, and owned cards, subject to lawful restrictions. Our Privacy Policy explains deletion requests and records we may need to retain.
We may suspend or terminate access for a material violation, fraud, security risk, or legal requirement. A closure does not erase a valid claim, accrued obligation, or ownership right. Provisions that by their purpose continue after closure, including payment obligations, ownership records, intellectual property, liability, and disputes, survive closure.
13. Warranties and liability
To the extent permitted by law, the service is provided as available, without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. This does not override an express promise in an offer, a confirmed ownership record, or a mandatory consumer guarantee.
To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive losses arising from the service. Our aggregate liability for claims relating to the service is limited to the greater of $50 USD or the amounts you paid us for the service during the twelve months before the event giving rise to the claim.
These limits do not apply where prohibited by law, do not extinguish ownership of a card or a valid account balance, and do not limit refunds or remedies that cannot lawfully be limited.
14. Claims arising from misuse
To the extent permitted by law, you agree to reimburse us for reasonable losses and expenses arising from a third-party claim caused by your fraud, unlawful use, material violation of these terms, or infringement of another person’s rights. This does not make you responsible for a claim caused by our own unlawful conduct or for obligations that applicable law places on us.
15. Governing law and disputes
Texas law governs these terms, excluding its conflict-of-laws rules. Disputes relating to these terms or the service will be brought in the state or federal courts in Texas, and you and Hypetheory LLC consent to those courts’ jurisdiction. These terms do not require private arbitration.
If mandatory consumer law gives you protections, a remedy, or the right to bring a claim in another forum, those rights remain available. You may contact us to try to resolve a concern before filing a claim, but doing so is not a condition of exercising a nonwaivable right.
16. Updates and general terms
We will show the revised date when these terms change and notify affected users of material changes before they apply. We will request agreement where required. A later revision does not retroactively alter an existing card allocation, accepted offer, or completed purchase.
If a provision cannot be enforced, it will be limited to the extent necessary and the remaining provisions continue. A failure to enforce a provision on one occasion is not a waiver. These terms and the policies and offer terms incorporated here form the agreement for the service, subject to applicable law.
The free waitlist provides launch updates, not a reservation, promised queue position, or guarantee of availability. You may stop marketing through the unsubscribe option or by contacting us.
